What is a Notary Public?

In England, a notary public plays a crucial role in authenticating and certifying documents for use abroad. Here's a breakdown of their key responsibilities:

Main Function:

  • Attesting the authenticity of documents: This goes beyond simply checking copies against originals. Notaries verify the identity of the signer, their capacity to sign (meaning they understand the document and are not under duress), and the validity of the document itself. This process ensures foreign courts and authorities readily accept the document without further checks.
  • Attaching their official seal: Each notary has a unique seal that adds an extra layer of credibility to the document.

Qualifications and Regulations:

  • Appointed by the Archbishop of Canterbury: They undergo a rigorous qualification process and are subject to strict regulations and ethical codes.

What is Notarisation?

Notarisation is the process of having a notary public officially verify and authenticate documents for use abroad. It goes beyond simply witnessing a signature and involves several key steps:

1. Verification of Signer: The notary confirms the identity of the person signing the document through valid ID and ensures they understand its contents and are acting willingly.

2. Capacity Check: The notary assesses the signer's mental capacity to enter into the agreement or action represented by the document.

3. Document Review: The notary checks the document for proper form and legality, adhering to the regulations of the country where it will be used.

4. Certification and Sealing: If everything is in order, the notary adds a certificate with their official seal, verifying the signature, identity, and capacity of the signer. This seal adds significant weight to the document abroad.

What is Legalisation / Apostille?

Legalisation and apostille in England serve a specific purpose when using certain documents internationally. Here's a breakdown:

  • Legalisation/apostille refers to the process of authenticating a UK document for use in another country.
  • Many countries also require notarised documents of the notary public to be legalised/apostilled. This is a double check to make sure that the notaries' signature is genuine and recognised by the UK Foreign, Commonwealth and Development Office. Once the authenticity of the signature is confirmed a certificate is attached, called an "Apostille".
  • Documents may also need to be checked by foreign embassies in the UK to make sure that the document has been properly notarised and apostilled. This requirement will depend on the foreign country involved.
